1. Agreement to Terms

Welcome to Evolucion Technologies. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and Evolucion Technologies ("Company", "we", "us", "our") regarding your access to and use of our website, digital platforms, tools, and services.

By accessing our website or using any of our products, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately cease using our platforms.

2. Products & Services

Evolucion Technologies designs, develops, and deploys digital platforms across education, finance, health, and lifestyle. These Terms apply to our general site and to the following specific platforms within our ecosystem, subject to any product-specific agreements:

  • Mentora Tanzania: An AI-powered EdTech platform supporting teachers with lesson planning and curriculum design.
  • Kibubu (Kirikuu Finance): Financial technology tools facilitating savings, access, and digital transactions.
  • Akili Tulivu: A mental fitness and mindfulness platform supporting daily emotional intelligence.
  • Pambana: A fitness and diet application guiding users through healthy living plans.
  • Gym and Diet: Lifestyle and nutrition planning tools helping users achieve wellness goals.
  • Tabia (Habits Planner): A wellness and habit-tracking platform.
  • Mavuno Sasa: Digital infrastructure supporting smallholder agricultural value chains.
  • Kiredio: An AI-powered writing assistant and text-to-speech assistant.

3. User Accounts & Security

Some of our platforms require registration. If you create an account, you agree to:

  • Provide accurate, current, and complete registration details.
  • Maintain the security of your password and identification.
  • Notify us immediately of any unauthorized use or security breach.
  • Accept full responsibility for all activities occurring under your account.

We reserve the right to terminate accounts that violate these security principles, provide false information, or engage in suspicious activities.

4. Acceptable Use

You agree to use our website and platforms only for lawful purposes. You are strictly prohibited from:

  • Attempting to interfere with, damage, disrupt, or bypass any security features of our services.
  • Using automated systems (bots, scrapers, crawlers) to harvest data from our systems without our prior written consent.
  • Using our platforms to distribute malware, transmit spam, or execute fraudulent schemes.
  • Uploading content that is illegal, abusive, defamatory, or infringes on third-party intellectual property.
  • Reverse engineering or attempting to extract the source code of any proprietary software or AI models we deploy.

5. Intellectual Property Rights

Unless otherwise indicated, all intellectual property rights—including software code, designs, databases, graphics, logos, text, and AI algorithms—are owned by or licensed to Evolucion Technologies.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access our services for personal or approved organizational use. You may not copy, modify, distribute, sell, or lease any part of our intellectual property without our explicit written permission.

6. Disclaimers

Our website and services are provided on an "as-is" and "as-available" basis. To the maximum extent permitted by law, Evolucion Technologies disclaims all warranties of any kind, whether express or implied, including but not limited to suitability, accuracy, reliability, and fitness for a particular purpose.

Specifically, we do not warrant that:

  • Our services will be uninterrupted, secure, or error-free.
  • The AI-generated insights (e.g., lesson plans on Mentora or writing suggestions on Kiredio) are completely accurate, complete, or suitable for every context. You assume responsibility for validating AI outputs before deployment.
  • All agricultural recommendations, fitness plans, or financial guides will guarantee specific outcomes.

7. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Evolucion Technologies, its founders, directors, or employees be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of (or inability to access or use) our website or products.
  • Any content or conduct of any third party on our services.
  • Any unauthorized access, use, or alteration of your data.

Our maximum aggregate liability for any claims arising out of these terms shall not exceed the amount paid by you to us (if any) during the six months preceding the event.

8. Suspension & Termination

We reserve the right, without notice and in our sole discretion, to terminate or suspend your license to use our platforms or block your access to the website if we believe you have violated these Terms, engaged in fraudulent behavior, or pose a security risk to other users.

Upon termination, all provisions of these Terms which by their nature should survive termination shall survive (including ownership, disclaimers, liability limitations, and governing law).

9. Governing Law & Dispute Resolution

These Terms and your use of our platforms are governed by and construed in accordance with the laws of the United Republic of Tanzania. This includes compliance with the Law of Contract Act (Cap. 345), the Cybercrimes Act (2015), and the Personal Data Protection Act (2022).

Any dispute arising out of or in connection with these Terms shall first be resolved through good-faith negotiation. If negotiation fails, the dispute shall be referred to and finally resolved by the competent courts of Dar es Salaam, Tanzania.
